1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the services provided by Freshhh Air Co. (“we,” “us,” or “our”). By engaging our services or visiting our site, you agree to be bound by these Terms.

2. Services Provided

We specialise in guest-booking services, podcast launch support, and content-repurposing for wellness brands, creators, and coaches. Detailed service descriptions and scopes are set out in individual proposals and agreements.

Any additional service outside of the agreed scope must be subject to a separate written agreement or addendum.

3. Client Obligations

You agree to provide timely access to required materials (audio files, branding assets, approvals) and to respond to communications promptly. Failure to provide necessary materials may delay deliverables and relieve us of related deadlines.

4. Payment Terms

Invoices are due within 7 days of issuance unless otherwise agreed in writing. Services begin only after receipt of the initial payment or agreed deposit. Late payments may result in suspension of work until payment is received.

5. Cancellation & Termination

Either party may terminate the agreement with 14 days’ written notice. In the event of early termination, you remain responsible for payment of services delivered up to the termination date. We may suspend or terminate services immediately in the event of unlawful or unethical use or breach of these Terms.

6. Intellectual Property

All materials created by us remain our property until full payment is made. After full payment, you receive the rights to use the deliverables for the purposes outlined in your agreement. You agree not to reproduce, distribute, or modify the deliverables beyond the scope without written permission.

7. Confidentiality

We both agree to keep confidential all non-public information received from the other party. This obligation remains in effect during and after termination of the agreement.

8. Limitation of Liability

Our liability for any service, whether in contract, tort (including negligence), or otherwise, is limited to the amount you have paid for the relevant service. We shall not be liable for any indirect, incidental, or consequential losses.

9. Warranties & Disclaimers

We provide our services “as is” and make no guarantees regarding specific results (such as guest bookings, metrics, or ROI) unless explicitly stated in your agreement. You agree that you are responsible for your own decisions and outcomes.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.

Freshhh Air serves clients globally; however, any dispute arising out of or relating to these Terms shall first be addressed through good faith negotiation between both parties.

If an agreement cannot be reached, the dispute shall be settled by mediation or arbitration in Molde, Norway, in accordance with Norwegian law.

By using our services, you agree that Norwegian courts and legal frameworks will have jurisdiction over any such disputes.

11. Changes to Terms

We may revise these Terms from time to time. We will post the updated version on our website and include the “Last updated” date. Your continued use of our services after the update constitutes acceptance of the new Terms.
